Facts About Probate Will

Probate is simply the process of getting the financial affairs of a person together and passing the assets on to his/or her beneficiaries.

Generally it is said that probate has 4 parts:

  • Collect the assets
  • Pay the debts
  • Pay the taxes
  • Distribute the balance to the heirs or beneficiaries

Simple things such as a missed deadline, failure to send a copy of the petition to a loved one, or a minor omission, can expose everyone to liability. If you need help with dealing with a loved ones' estate and prevent liability, contact one of our Probate Will Lawyers now.

Keep in mind that although most probate proceedings are short and not very expensive, it is a very good idea to consult an Probate Will Attorney to determine many things. For instance, is a probate proceeding necessary? Does the fiduciary need to be bonded? What reports must be prepared?

A Probate Will Lawyer can also determine the types of property that routinely pass outside of the probate process such as:

  • Life insurance or retirement plan proceeds, which pass to a named beneficiary rather than your estate
  • Real-estate or bank or brokerage accounts held in joint names with right of survivorship

The death of a family member or a friend sometimes tends to bring out the very worst in some people. In close families there is a tendency to get extremely emotional about somewhat trivial matters at the time of a loved one's death.

Contact a Probate Will Atorney now to receive a professional consultation.

  Did You Know?

A Wrongful Death Is Treated In The Same Manner As A Regular Probate.

Probate would still apply to the administration of the decedent’s estate.  Action may be taken in a separate civil case for a wrongful death action.  If a wrongful death action is the only asset of the estate, many courts have a different process than regular probate.
